Terms of Service

By ordering a commission you confirm that you are familiar and agree with the following Terms of Service.

Base Information

a. As a part of a commission you purchase a digital artwork(s)
b. My art is made without using genAI technology, I prohibit using this technology on my artworks in any way
c. I remain the author of the picture, you do not purchase authorship
d. The base image is sold without Commercial License and is intended for Private Use only (see: Commercial Licence if you need it)
e. You need to fully disclose the ways in which you want to utilize the artwork outside of Private Use
f. Private Use allows you to print the picture for yourself (or make mugs, stickers and other fun stuff) but NOT to sell it or make indirect profit from it
g. Both Private Use and Commercial Use allows you to share the picture on your own social media as long as you tag me and add a link to one of my portfolios
h. I keep the right to use the finished picture in my portfolio and other places that showcase/promote my work
i. The final image will contain my signature for Private Use images

Pricing

a. The prices of the commissions are divided into three categories - "sketch", "simple" and "painted"SKETCH - is a quick, rough art, and it may contain imperfections such as uneven linework, crayon marks and others.
They cost 18/45/60 Euro for portrait/halfbody/fullbody.

SIMPLE - simple artworks are rendered pieces, but they have no background
They cost 30/75/100 Euro for portrait/halfbody/fullbody.

ILLUSTRATED - full illustrations with background.
They cost 50/120/200 Euro for portrait/halfbody/fullbody BUT depending on the background complexity, they may cost more. Painting only a background costs 100 Euro, more if architectural elements are present

Commission process

PRE-COMMISSION
a. After filling in the google form, you'll be automatically placed on a waiting list. You will receive an email with confirmation and a link to a queue where you can see your placement
b. When I'm ready to process your request, you will receive a second email asking you to send me details about your order, as well as visual references. You have 5 days to provide me references, or your order will be cancelled
c. All of the communication will be happening via email. I won't join discord groups or similar spaces
d. I can decline your order after seeing the references. In this case I won't charge anything.
e. After I analyze your references, I shall send you the final price of the image. The date an hour of payment starts the time counting towards my deadline
SKETCH PHASE
a. After paying the first invoice I prepare a sketch
b. You can request two more entirely new sketches, if you don't like the first one. Fourth one requires additional payment (see: Major change)
c. After you pick a sketch for rendering, you have to pay a second invoice. This begins the final phase
FINAL PHASE & CHANGES
a. After the rendering phase starts, only minor changes are available
MINOR CHANGE - A change to the picture that doesn't require me to repaint a large chunk of the art. For example: small pattern changes, face expression, item color
MAJOR CHANGE - A change to the picture that requires me to alter large portions of art. For example: whole body position, previously unmentioned item added. Major change requires additional payment:
25% of the artwork for a new sketch
50% of the artwork for changing render element
COMMISSION ENDS
a. When everything is done, you will receive a set of PNG files, with at least one larger file and one smaller preview sent via email or as a link
b. The pictures average 1024/1600/1920 pixels tall for portraits/halfbodies/fullbodies. If you require anything larger, let me know before the commission starts
c. You won't be sent the original PSD file, layers or separated parts of the picture. For illustrations (the painted pictures with the background) there is no free "backgroundless" version

Payment

a. Payment is accepted via PayPal or Wise only
b. The invoice will be set in Euro. I don't accept other currencies
c. Payment for the commission is divided to two invoices: 50% sent after I analyze your references and and 50% after you accept a sketch for rendering
d. In case of sketch commission, the payment is also divided to two invoices, but the second one comes after a black-and-white rough sketch
e. First invoice is non refundable under any circumstances

Deadline and Refunds

a. From the moment of the first payment I have 60 days to complete an order for a single picture. If you order two pictures, double the time etc. If the picture has multiple characters in it, the deadline may also be a bit longer (~10 weeks max)
b. If I don't complete your order in time, you are eligible for a refund
c. HOWEVER, if during the commission process you don't respond to my email for more than 24 hours, I stop counting days to deadline until the communication is reestablished. In such situation deadline is extended accordingly
d. The refund does NOT apply if:
- the client gets verbally abusive
- the ToS is breached by the client
- there's no email response from the client for more than 60 days
- the client changes their mind and doesn't want the artwork anymore

References

a. To paint a picture for you I need visual references and written description
b. I won't recreate (1:1) a character art that you have found online (that was not painted by you or for you). I can only use that sort of reference to create new design based on it
c. I won't recreate designs made by generative AI

Commercial License

a. You always need to inform me to what extend do you plan to use my artworks.
b. The commercial license you purchase only applies to the usage we establish in the emails. If later on you require more ways to use the artwork, you need my written permission. This may requite paying an additional fee
b. The commercial license applies if you plan to use my artwork as merchandise, patreon reward, part of marketing or promotional material, an illustration in a book or other similar medium & more
b. The commercial license has certain tiers:
- Book illustrations/TTRPGs/physical games and their marketing costs +25%
- Game development projects require +50% additional fee
- Merchandise of any sorts require +100% additional fee
c. I keep the right to raise those prices at any moment. If you want to modify your commercial license after the raise (for example, upgrading from Publishing to Merch year after the purchase) you need to pay the new fee
d. If you require an NDA, I need to be informed about this beforehand. NDA will cause me to impose additional fees on the final price:
+25% if the NDA is shorter than 3 months
+50% if the NDA is 3-6 months
+100% if the NDA is 6-12 months
+200% if the NDA is 12-24 months
e. Commercial license does not include a free promotion of your product! You do not purchase control over my portfolio or social media posts. Unless we have an NDA or you purchase my endorsement, I am able to post the picture on my own terms any write any description I desire
f. For orders above 500 Euro I require an additional written contract between both parties

What can you do with the art?

a. As you are the owner of the artwork, you can use the picture online for your social media/forums or similar. You can also print yourself a physical copy (if you need my help in preparing the files for printing, I do that for free!). That includes mugs, stickers and other fun stuff, but remember NOT to sell any of it without commercial license!
b. You can purchase additional commercial license after the piece is done
c. You can post the picture into your social media, but remember to tag me and link one of my portfolios
d. I prohibit using the final artwork in genAI edits, animations or similar
e. I do not agree for anyone to overpaint/severely alter the piece without my permission. Small colour, contrast & framing changes are ok. When in doubt - always ask

Banned Subjects

What I won't paint:
a. Real people, including but not limited to: celebrities and public figures, your friends and family, yourself (even in fantasy rendition)
b. I won't paint your pet
c. I won't render characters based on NFTs or for the purpose of being used as NFT
d. I do not paint real life guns (fantasy/scifi/historical guns predating XX century are ok)
e. The same applies to real life military uniforms (those from XVIII century and below are mostly ok)
